On the 1st of January 2016, the regulation came into force which obliged all communications with the Administration of Justice in Madrid to be carried out through telematic systems, in order to alleviate the disorder and accumulation of paperwork in the different Madrid Courts.
Although this system has been in use in other provinces and Autonomous Communities for some time, it was not yet operational in Madrid. The Lawyers of Madrid have made an enormous effort to adapt to the new regulations, changing systems and computer equipment.
However, to date, the Community of Madrid has not established the necessary systems, and we find that all the Courts tell us that they are not trained, that they do not have the necessary tools or even scanners.
On the other hand, the lawyers, most of whom are in the Lexnet system, continue with the uncertainty of having to enter Lexnet every day because if a communication is made and we do not pick it up, we could be considered to have been notified.
The Dean of the Madrid Bar Association herself, Sonia Gumpert, said that the implementation of the LexNet system, the platform for the exchange of telematic information in Justice, "is not working as it should", partly because "the Community of Madrid has not done its homework".
He did so at the presentation to the media of the "Committed to Work-Life Balance" programme, which aims to facilitate the family and working life of the almost 80,000 lawyers in Madrid.
We fully agree with the dean that there is an absolute lack of planning on the part of the Administration of Justice and the Community of Madrid, not enabling the access and operation of the platform that should have come into force with the objective towards the so-called "0 paper", in force since 1 January.
