The revised text of the Law on Civil Liability and Insurance in the Circulation of Motor Vehicles, approved by Royal Legislative Decree 8/2004, of 29 October, establishes that annually, with effect from 1 January of each year, the compensation amounts included in the system for the valuation of damages and losses caused to persons in traffic accidents must be updated and, failing that, they will be automatically updated by the percentage of the general consumer price index corresponding to the immediately preceding calendar year.

For this reason, a resolution is published annually establishing the amounts of compensation for death, permanent injury and temporary disability that will result from applying the system for the valuation of damages and losses caused to persons in traffic accidents in each financial year.

For the 2011 financial year, according to the Resolution of 20 January 2011, of the Directorate General of Insurance and Pension Funds, which publishes the amounts of compensation for death, permanent injury and temporary disability that will result from applying the system for the valuation of damages caused to persons in traffic accidents during 2011 in accordance with the following:

(1) In general:

  • (a) In the case of children, adopted children shall also be included.
  • (b) Where different amounts are fixed according to the age of the injured party or beneficiary, the age of the injured party or beneficiary at the date of the victim's accident shall apply.

(2) Spouse not legally separated at the time of the accident.
Consolidated de facto marital unions shall be assimilated to legal situations.

(3) Legal separation and divorce shall be treated as equivalent to the absence of a spouse. However, if the separated or divorced spouse is entitled to the pension provided for in Article 97 of the Civil Code, he/she shall be entitled to an allowance equal to 50% of those fixed for the spouse in Group I.

In cases of concurrence with de facto marital unions or, as the case may be, of the former or the latter with spouses who are not legally separated, the compensation fixed for the spouse in group I shall be distributed among the concurrent partners in proportion to the amount that would have corresponded to them had there been no concurrence.

(4) The total amount of compensation due according to the number of children shall be apportioned equally between them.

(5) If there is a cohabiting child and a non-cohabiting child, 50 per cent of the amount of the respective amount shall be allocated to each of them.

(6) The total amount of compensation shall be divided 50/50 between the paternal and maternal grandparents.

(7) The total amount of compensation due according to the number of siblings shall be divided equally between them.

People affected with permanent sequelae that require the help of other people to carry out the most essential activities of daily life, such as dressing, moving around, eating or similar (tetraplegia, paraplegia, states of coma or chronic vegetative states, important neurological or neuropsychiatric sequelae with serious mental or psychic alterations, complete blindness, etc.):        
Need for help from another person:    
Taking into account the victim's age and degree of incapacity to carry out the most essential activities of life. The cost of care in cases of coma vigil or chronic vegetative states is assimilated to this benefit Up to 383.450,65. -
Adaptation of the home        
Depending on the characteristics of the home and the circumstances of the disabled person, according to their needs Up to 95.862,67. -
Moral damages for relatives:

(2) This compensation shall be payable even if the pregnant woman has not been injured.
